Employment creation in EB5 cases
In the decision dated March 15, 2010, AAO offered a concise, solid definition of employment in EB5 cases. According to the decision, full time employment is at least 35 hours a week, continuous, permanent employment. The ever-soaring issue is with construction jobs, and in this case, AAO determined that "construction workers utilized for a limited construction phase of less than 3 years could not serve to satisfy the employment creation requirement."
